This document will give you a voice with medical decisions about your treatment or care in the event you are incapable of communicating. This Healthcare Directive can provide your family with incredible peace of mind, being knowledgeable and able to follow your wishes at a difficult time. It gives your chosen representative the authority to demand health providers follow your wishes.
In the span of even a couple weeks following a health event, unattended business or insurance matters can turn into financial disaster. If you encounter a health event that requires you to focus all your energy on recovering, a document called a Power of Attorney will allow your chosen representative to handle your business affairs and insurance matters, as well as assist with attending to your appointments.
These documents attend to who will represent your estate after you pass, and will detail exactly how, when and to whom you want your wealth and belongings to be distributed, and/or your business to move forward. Without these correctly drafted testamentary documents, the government can end up receiving a substantial portion of your estate. Wouldn't you rather keep it in the family, caring for your loved ones, or going to an organization or cause you care about?
If you have Minor Children, or a family member with Special Needs, it is important to discuss the custodial needs that would arise in your absence. These can be addressed in a variety of ways, unique to each family and individual.
It is best to address the needs for an incapacitated adult or child through other means than Guardianship or Conservatorship, because these involve the removal of an individual's constitutional rights, placing them in the hands of another and should be a last resort. We can explore options when it seems your loved one might need a representative.
When you execute your various planning documents, things can change over time. Families change, estates change, health changes, business changes, and your philosophy can change over time as well - especially as you journey through the different seasons of life. It is important to review your planning documents and update them when changes occur, or at least every five years.
